DSGVO – General Data Protection Regulation

From May 25, 2018, the EU General Data Protection Regulation (GDPR) must be applied in almost all German companies. Almost every company is from the new regulations affected, since almost every company: customer, employee data and data from business partners processed. I listed here the EU General Data Protection Regulations: (GDPR), be patient while reading.

Data protection:
Personal data (hereinafter mostly referred to as “data”) will only be used by me within the scope of the necessity and purpose of providing a functional and user-friendly internet presence, including its content and that, offered there Services, processed.

According to Art. 4 number 1 of regulation (EU) 2016/679, i.e. the data protection basic regulation (hereinafter referred to as “GDPR”) is considered “processing” everyone with or without the help of automated procedures executed process or any such series of processes in the context with personal data, such as collecting, the organization, storing, adapting or change, reading, querying, using, disclosure by transmission, distribution or another form of provision, reconciliation or linkage, restriction, deletion or the destruction.

Besides, I will inform you below about mine for optimization purposes and to increase the quality of use third-party components used, insofar as this results in third-party data in again process on your responsibility.

I. Rights of users and data subjects
With regard to the data processing described in more detail below, users and data subjects have the right to confirmation as to whether the data relating to them are being processed, information about the processed data, further information about data processing and copies of the data (see also Art. 15 GDPR); to correct or complete incorrect or incomplete data (see also Art. 16 GDPR); to the immediate deletion of the data relating to them (cf. also Art. 17 GDPR), or, alternatively, if further processing in accordance with Art. 17 Para. 3 GDPR is required, to a restriction of processing in accordance with Art. 18 GDPR; on receipt of the data concerning them and provided by them and on the transmission of this data to other providers/responsible persons (cf. also Art. 20 GDPR); on complaint to the supervisory authority, provided they believe that the data concerning them will be processed by the provider in violation of data protection regulations (see also Art. 77 GDPR).

In addition, the provider is obliged to inform all recipients to whom data have been disclosed by the provider about any correction or deletion of data or the restriction of processing that takes place on the basis of Articles 16, 17 Paragraph 1, 18 GDPR teachings. However, this obligation does not exist if this communication is impossible or involves a disproportionate effort. Notwithstanding this, the user has the right to information about these recipients.

The users and data subjects also have per Art. 21 GDPR the right to object to the future processing of their relevant data, or provided data by the provider per Art. 6 Para. 1 lit. f) GDPR. In particular, there is an objection to data processing permitted for direct advertising.

II. Information on data processing
Your data processed when you use my website will be deleted or blocked as soon as the purpose of storage no longer applies, the deletion of the data does not conflict with any statutory retention requirements and no other information on individual processing methods is given below.

Server data
For technical reasons, in particular, to ensure a secure and stable website, data is transmitted through your internet browser to me or to my web provider. With these so-called server log files. Type and version of your internet browser, the operating system, the website from which you switched to my website (referrer URL), the website (s) of my website that you visit, the date and time of the respective access and the IP address of the Internet connection from which my website is used. The data collected in this way is temporarily stored, but not together with other data from you.

The data will be deleted after seven days at the latest, as long as no further storage is required for evidence purposes. Otherwise, all or part of the data will be excluded from deletion until an incident is finally clarified.

Contact request/contact options
If you contact me using the contact form or email, the data you provide will be used to process your request. The specification of the data is necessary for processing and answering your request – without providing it, I can not answer your request or at least to a limited extent. The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR. Your data will be deleted, provided that your query has been answered in the end and there are no legal retention requirements to the deletion, such as in the event of subsequent contract execution.

Google Analytics
I use Google Analytics on my website. This is a web analysis service from Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google”.

Through certification according to the EU-US Privacy Shield (“EU-US Privacy Shield”) https://www.privacyshield.gov/participant?
id=a2zt000000001L5AAI&status=Active Google guarantees that the EU data protection regulations will also be complied with when processing data in the USA.

The Google Analytics service is used to analyze the usage behaviour of my website. The legal basis is Art. 6 Para. 1 lit. f GDPR. My legitimate interest lies in the analysis, optimization and economic operation of my website.

Usage and user-related information, such as IP address, location, time or frequency of visits to my website, are transmitted to a Google server in the USA and stored there. However, I use Google Analytics with the so-called anonymization function. With this function, Google shortens the IP address within the EU or the EWR. The data collected in this way is in turn used by Google to provide me with an evaluation of the visit to my website and the usage activities there. This data can also be used to provide other services related to the use of my website and the use of the Internet.

Google also offers a so-called deactivation add-on at https://tools.google.com/dlpage/gaoptout?hl=de along with further information. This add-on can be installed with the usual Internet browsers and offers you further control over the data that Google collects when you access my website. The add-on notifies the JavaScript (ga.js) from Google Analytics that information about visiting my website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to me or to other web analysis services. Of course, you will also find out in this data protection declaration whether and which other web analysis services I use.

Data protection
If there is a possibility to enter personal or business data (email addresses, names, addresses) on the website, the disclosure of this data by the visitor is on an expressly voluntary basis. The use and payment of all services offered are – as far as technically possible and reasonable – also permitted without providing such data or by entering anonymized data or a pseudonym. Customer-related data are used exclusively for customer care (sending information). The disclosure to third parties is excluded.

What data I collect and why
When visitors leave comments on my site I collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies
If you leave a comment on my site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. If you have an account and you log in to this site, I will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, I will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded contents
Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

How long I retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so I can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on my website (if any), I also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have
If you have an account on this site, or left comments, you can request to receive a file of the personal data I hold about you, including any data you have provided to me. You can also request that I erase any personal data I hold about you. This does not include any data I am obliged to keep for administrative, legal, or security purposes.

Where I send your data
Visitor comments may be checked through an automated spam detection service.
